Defense attorneys have a tendency to wear theirs. Most prosecutors have been trained to keep it in their pockets as to not draw immediate attention to themselves. It wouldn't be very wise to be an open target for the people we're attempting to convict.
Possibly, but most of the defense attorneys I've met have been ridiculous enough that they don't think of it that way. Besides, the job of the defense is to prove the innocence of their client. I'm sure most culprits would want to be on their good side.
